I dont think ivory is illegal, the poaching of the animals who wear it, is. I think that xylophone is just ivory color, not actual ivory. I may very well be wrong, but I couldn't find any info on that actually being made of ivory. If it was ivory I think that would sound really weird. Arent they supposed to be made of hardwood? The xylophone was originally modeled after an African instrument and its name is Greek, meaning "wood sound".
