I know that eBay does regulate the sale of "lawsuit-era" instruments. A friend had a bid on some "forbidden" Les Paul that Ibanez made in the 70's; he was sent an email that the auction was closed because this was a patent-infringed item. Someone at Gibson (other manufacturers do this too; Fender, and Rickenbacker are two that come to mind) patrols the site to see if any of these instruments are up for sale.
